Welcome to Motion. These Terms of Service ("ToS") govern your use of the Motion wallet application ("Service") for interacting with the XRP Ledger. By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
Definitions
- "Service" refers to the Motion wallet application, including its website and related features.
- "Wallet" refers to a cryptographic wallet that allows you to store, send, and receive XRP and other tokens on the XRP Ledger.
- "User", "you" or "your" refers to the individual accessing or using the Service.
- "We", "us" or "our" refers to Motion and its affiliates.
Eligibility
You must be at least 18 years old to use the Service. By using the Service, you confirm that you are legally allowed to use it under United States laws and any applicable local laws.
Nature of the Service
The Service provides tools to interact with the XRP Ledger, including creating, accessing, and managing XRPL wallets. We do not control or store your private keys, seed phrases, or wallet contents. You are fully responsible for safeguarding this information.
User Responsibilities
- Secure Your Wallet: You are solely responsible for your wallet's private key, seed phrase, and credentials. Losing this information may result in the loss of access to your funds.
- Compliance with Laws: You must comply with all United States laws and applicable international laws while using the Service.
- No Illegal Activities: You may not use the Service for unlawful or fraudulent activities, including money laundering, unauthorized access, or hacking.
- No Recovery Guarantee: If you lose your private key or seed phrase, we cannot recover your wallet or funds.
Fees and Payments
The Service may be free or subject to fees as determined by us. You acknowledge that XRP Ledger transactions incur network fees paid directly to XRPL validators. We have no control over these fees.
Security and Risks
By using the Service, you acknowledge the following risks:
- Loss of private keys or seed phrases can result in permanent loss of access to your funds.
- Unauthorized access to your wallet could compromise your assets.
- The XRP Ledger network may experience downtime or delays.
- You are responsible for securing your devices, passwords, and access points.
Motion is not responsible for any loss resulting from your use of the Service.
Third-Party Services
The Service may integrate with third-party services (e.g., exchanges, blockchain explorers). We do not control these services and are not responsible for their performance, availability, or security.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Motion shall not be liable for:
- Loss of funds, wallet access, or data.
- Any indirect, incidental, special, or consequential damages arising out of your use of the Service.
Indemnification
You agree to defend, indemnify, and hold harmless Motion, its affiliates, and employees from any claims, damages, or expenses arising from:
- Your use of the Service.
- Violations of these Terms.
- Third-party claims related to your actions.
Termination
We reserve the right to suspend or terminate your access to the Service at any time for any reason, including violations of these Terms.
Changes to the Terms
We may update these Terms at any time. You will be notified of changes, and your continued use of the Service signifies acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the United States, without regard to its conflict of laws principles.
